2. Information We Collect

Account holders (tradespeople subscribing to InstantLead):
- Name, business name, and email address
- Phone number and business phone number
- Billing information (processed securely via Stripe; we do not store card details)
- Account preferences and configuration settings
- Usage data (features used, log-in times, dashboard activity)
Callers (your customers whose calls are missed):
- Phone number (captured from the inbound missed call)
- SMS conversation content (messages exchanged with the InstantLead AI on your behalf)
- Job details or other information voluntarily provided during the SMS conversation
Website visitors:
- Browser type, IP address, and pages visited (via standard web server logs and analytics)
- Cookie data (see Section 9 below)
3. How We Use Your Information
We use personal information only for the purposes for which it was collected:
- Delivering the InstantLead service — automatically texting missed callers, capturing lead details via AI, and notifying subscribers via email and SMS
- Account management, billing, and customer support
- Improving and developing our platform (using aggregated, de-identified data where possible)
- Sending service-related communications (account alerts, feature updates)
- Sending promotional communications — you may opt out at any time by emailing us or clicking the unsubscribe link
- Complying with legal obligations
4. SMS and Call Data
A core function of InstantLead is processing inbound missed call events and sending automated SMS messages to callers on behalf of subscribing tradespeople. In this context:
- The subscriber's customers' phone numbers are processed solely to deliver the missed-call follow-up service.
- SMS conversation content is stored in the subscriber's account dashboard and is accessible only to the subscriber and authorised InstantLead staff for support purposes.
- Caller data is not used for our own marketing and is not sold to third parties.
- Subscribers are responsible for ensuring their use of InstantLead complies with the Spam Act 2003 (Cth) and ACMA guidelines, including any consent obligations relevant to their industry.
5. Data Storage and Security
All personal information collected by InstantLead is stored on secure cloud infrastructure located in the Australian region. We apply the following security measures:
- Encryption in transit (TLS/HTTPS) for all data transfers
- Encryption at rest for stored data
- Access controls limiting staff access to personal information on a need-to-know basis
- Regular security reviews and monitoring
No data storage or transmission method is 100% secure. If a data breach occurs that is likely to cause serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches (NDB) scheme.
6. Third-Party Service Providers
We share personal information with trusted third-party providers only to the extent necessary to deliver our service:
- SMS gateway providers — to send and receive SMS messages on behalf of subscribers
- Stripe — to process subscription payments securely
- AI / language model providers — to power automated SMS conversation responses (data is processed under strict data processing agreements)
- Analytics providers — to understand website usage (using anonymised or aggregated data where possible)
We do not sell personal information to any third party.
7. Disclosure of Personal Information
We will not disclose your personal information to any other party except:

8. Data Retention
We retain personal information for as long as your account is active and for a reasonable period afterwards to meet our legal and business obligations. Specifically:
- Account data is retained for the duration of your subscription plus 7 years (to satisfy Australian tax and record-keeping obligations)
- Caller SMS conversation data is retained for 2 years from the date of the conversation, unless you request earlier deletion
- You may request deletion of your personal information at any time by contacting us (see Section 10)

Our website uses cookies and similar technologies to improve your browsing experience and gather analytics. Cookies are small text files stored on your device. You can disable cookies in your browser settings, though some features of the website may not function correctly without them.
